For sure the commission’s decision will strongly affect all commercial yacht qualifying as “a pleasure yacht registered for commercial purposes” according to MCA.
Indeed the VAT exemption given by article 148 of the VAT Directive only applies to units registered under the regime of the MERCHANT marine.
So all owners should verify if their flag offers the option to register their yacht as unit of the MERCHANT vessel.
As a matter of fact Luxembourg was a pioneer in that sector, when it developed its technical code for that category of vessels in 1993 and by that offering registration of a mega-yacht as “MERCHANT vessel”. This option was operated in application of article 91 of the Montego Bay Convention, so this MERCHANT registration of mega yachts is internationally protected.
Being part of the MERCHANT navy , your yacht, registered in Luxembourg, qualifies to get the benefit of VAT exemptions strictly reserved to the MERCHANT navy and sails the European waters under the protection of the cabotage Directive.
So in VAT matters, your entitlement to the benefit of VAT exemptions is strictly conditioned by the MERCHANT registration of your yacht.
